References to “Jado Arly”, “Provider”, "eLearning Platform", “we”, “us”, and/or “Our” throughout the website is to Jado Arly SARL. These are the terms and conditions (the “Agreement”) governing your participation in www.jadoarly.com (the “Website”) owned and operated by Jado Arly SARL. By participating you agree to these terms, which form a binding legal contract between Jado Arly SARL and the registered participant (“You”, “Member”, “User”, “Learner”, “Customer” or “Participant”).
These Terms of Use should be read alongside, and are in addition to our Privacy Policy and Cookies Policy to understand how we collect and process your personal data. Please read these Terms of Use carefully and print a copy for your future reference. You agree to use the Website only for lawful purposes and in a way which does not infringe the rights of anyone else or restrict or inhibit anyone else's use and enjoyment of the Website. By engaging and participating with our eLearning Content (“Subscription Plan”, “The Makeup Academy”, “TMUA”, “The eLearning Makeup Academy“, “The Makeup Academy Skin” or “TMUA Skin”, “The Makeup Academy Color” or “TMUA Color”, "E-Learning Courses", “Micro eLearning”, “Full Courses“, "First Things First", "Skin Tone Perfection", " Color Wiz", "EyeCHITECTURE", "Skin+", "Color+", “Virtual Beauty Consultation”, “VBC”, “Appointment”, “One-on-One Consultation”, “Beauty Workshop”, "BW”) you agree to these terms.
When you signup for paid membership you get a license from us to stream on demand E-learning videos and to download the Learners’ Edition. Don’t try to transfer or resell content in any way. We generally grant Subscription Plans/Memberships valid for 2 months from the date of purchase.
You are permitted to print the Learners’ Edition if available after purchasing a membership or enrolling from the Website solely for your own personal use. If you download The Learner’s Edition material from our site, all the material and data are deemed to be licensed to you by Jado Arly, for your personal, non-commercial use only. Jado Arly does not transfer either the title or the intellectual property rights of the Content and Jado Arly retains full and complete title to the courses as well as all the intellectual property rights therein.
Website content, including without limitation, all information, data, products, materials, services, software applications and tools, design elements, text, images, photographs, illustrations, audio and video contents, LiveChat conversations, and VideoChat exchanges and artwork and graphics contained therein or otherwise made available to you in connection therewith (collectively, the “Content”), must not be copied or reproduced, used or otherwise dealt with for any other reason. You are not entitled to modify or redistribute the Content or reproduce, link, frame or deep-link it on any other website without our express written permission. You are not entitled to use the content of the Website for commercial exploitation in any circumstances. You are not entitled to make recordings of the Website or any Content.

3. YOUR ACCOUNT
If you choose, or you are provided with, an account, username, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. You are responsible for maintaining the confidentiality of your account, username and password and for restricting access to your computer. If there has been an unauthorized use of your password or account, please notify us immediately. You are responsible for keeping such information current, complete, accurate and truthful. You agree to accept responsibility for all activities that occur with your permission or authorization under your account, username and/or password, or because you fail to maintain sufficient security over your account, username and/or password. Users can sign up for a free membership to access the calendar and schedule a Virtual Consultation appointment online.
For full access to The Makeup Academy's on-demand video library, users should sign up for a paid membership by clicking the 'Enroll Now' button. There are three different E-learning modules available: Full Courses, Micro eLearning, One-On-One Virtual Workshop.
Users with a free membership can access E-learning Content after upgrading or purchasing one of the many E-learning packages, using the same email and password. It is crucial to keep your password secure, as you are responsible for all activity associated with your account. If you suspect unauthorized use, please contact our Support Team.
To use Jado Arly's services, you must have reached the age of consent for online services in your respective country.
5. USER CONTENT
Whenever you post content, such as a review, to our Website you must comply with the provisions set out below: You may only use this Website for lawful purposes. We do not guarantee that the material will be fault free and do not accept liability for any errors or omissions. We do not give any warranty that the website is free from viruses or anything else, which may have a harmful effect on any technology. Jado Arly makes no representation whatsoever regarding the content of any other websites, which you may access from the courses. A link to a non-Jado Arly website does not mean that Jado Arly endorses or accepts any responsibility for the content or use of such websites. We may terminate your use of the Website with immediate effect if you breach any of these Terms of Use.We do not guarantee that our site, or any content on it, will always be available or be uninterrupted.

10. PAYMENTS
We use third party payment providers, depending on the way in which you make payments – NetCommerce & Mastercard. Payment for the Products must be made at the point of purchase. You agree to provide payment for the Products in the stipulated currency and you will be liable to pay any relevant conversion charges, as well as applicable sales tax in your region. Please note that we must receive your payment in full before providing you with access to the Products. You agree to pay the fees for content that you purchase, and you authorize us to charge your debit or credit card or process other means of payment. We works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using information provided by our payment service providers. Check out our Privacy Policy for more details. When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the content you are enrolling in, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any content for which we have not received adequate payment. Your payment includes the licensing of the Products for a limited period of time that is appropriate for the eLearning content. We are unable to provide a refund if you fail to complete the content within the allocated time, except at our absolute and sole discretion. We reserve our right to review and change the pricing of any of our products. This will not affect products that have already been purchased. We occasionally run promotions and sales for our content, during which certain content is available at discounted prices for a set period of time. The price applicable to the content will be the price at the time you complete your purchase of the content (at checkout). Any price offered for particular content may also be different when you are logged into your account from the price available to users who aren’t registered or logged in, because some of our promotions are available only to new users. If you are logged into your account, the listed currency you see is based on your location when you created your account. If you are not logged into your account, the price currency is based on the country where you are located. We do not enable users to see pricing in other currencies. Goods and services tax, or value added tax is applicable to consumer sales, we are responsible for collecting and remitting that tax to the proper tax authorities. Depending on your location, the price you see may include such taxes, or tax may be added at checkout.
11. CURRENCY & EXCHANGE RATE
You may book in USD or your local currency and the default currency will be selected by our website according to your location, but can be altered if you choose. RQA exchange rates used are based on those published by The Financial Times and will be updated regularly.
12. INTELLECTUAL PROPERTY/COPYRIGHT
The copyright in the material contained in the courses, together with the design, text and graphics, compilation belong to Jado Arly. All rights are reserved. None of this material may be reproduced or redistributed without Jado Arly’s written permission. However, if available, you may download or print a single copy of The Learners’ Edition for your own non-commercial viewing. If you download The Learner’s Edition material from our site, all the material and data are deemed to be licensed to you by Jado Arly, for your personal, non-commercial use only. Jado Arly does not transfer either the title or the intellectual property rights of the course and Jado Arly retains full and complete title to the courses as well as all the intellectual property rights therein. You may not sell, redistribute or reproduce or convert any of the material. Jado Arly owns all trademarks and logos and you may not copy or use them in any manner.
13. THE MAKEUP ACADEMY MEMBERSHIP
When You subscribe for a paid membership to TMUA Skin, TMUA Color, and/or TMUA Skin + Color, you get a limited, non-exclusive, non-transferable license from us to access and view the content included in that Subscription Plan for 2 months from the date of payment. You may not transfer, assign, or share your subscription with anyone else. We reserve the right to revoke any license to use the content in our Subscription Plans for legal or policy reasons at any time and at our sole discretion, such as if we no longer offer the content through a Subscription Plan. You may download The Learner’s Edition material from our site, all the material and data are deemed to be licensed to you by Jado Arly, for your personal, non-commercial use only. Jado Arly does not transfer either the title or the intellectual property rights of the course and Jado Arly retains full and complete title to the courses as well as all the intellectual property rights therein. You may not sell, redistribute or reproduce or convert any of the material. Single Course Membership: You will have access to the courses you have purchased for 2 months from the date of purchase. Double Course Membership: You will have access to all courses and material you have selected for 2 months from the date of purchase.
14. VIRTUAL ONE-ON-ONE WORKSHOPS AND BEAUTY CONSULTATION
By Booking a Virtual Beauty Consultation, you acknowledge and agree that virtual event, in its sole discretion, reserves the right to change any and all aspects of the virtual event, including but not limited to, the virtual event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. Accessing the calendar to make a booking requires users to signup for a membership (free or paid), at the very least. Members with existing memberships (free or paid) intrinsically have access to the Virtual Beauty Consultation calendar. By participating in the Virtual Beauty Consultation, content maybe recorded by Jado Arly FZE and maybe accessible to you post consultation as a reference. You grant Jado Arly the right, and Agree, to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise for the purpose of the consultation without any further approval from you or any payment to you. This grant to Jado Arly includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information for the purpose of the consultation. Prior to your Appointment, you will be invited to complete a Pre-Consultation Questionnaire. This is not compulsory, but will assist the Pro Makeup Artist provide you with a more tailored service. If you choose to provide this information, any personal data you provide will be treated in accordance with our Privacy Policy here. You must be aged 18 or over to book and attend an Appointment. Only one person may attend the Appointment. If you do not join within the first ten minutes of the Appointment then we are under no obligation to go ahead with the Appointment and may cancel it at our discretion, without any obligation to provide you a refund or rescheduled Appointment. If the Pro Makeup Artist does go ahead with the Appointment, it will not run over the allotted time, even if the Appointment starts late. If you do not attend your appointment or you fail to comply with the requirements under these terms & conditions you will not be entitled to cancel or reschedule the Appointment. The type of Appointment available (Eye-chitecture Blue Print) will be at our discretion, and made available on https://www.JadoArly.com. We cannot guarantee availability of Appointments, and reserve the right to change or cancel them at any time. During an Appointment a Pro Makeup Artist reserves the right to cancel or abort the Appointment at any time, should they feel it appropriate to do so. Any information and/or product recommendations made by a Pro Makeup Artist are for informational purposes only. All Appointments will be carried out in the English or Arabic language. You will not be able to select a specific Pro Makeup Artist to carry out your Appointment, and the Pro Makeup Artist selected for your Appointment will be entirely at our discretion and subject to change at any time. The Appointment transmission will pass over public telecommunications networks. We make no representation or warranty that the operation of the Appointment will be uninterrupted or error free and disclaim all liability in respect thereof. The Service will at all times be subject to the Website Terms and Conditions of Use and, where a Service is a paid for Appointment, the Terms of Use. In the event of a conflict, these Terms of Use for Virtual Consultations shall take precedence. You must not record your Appointment (video and/or audio). The Service is only available to eligible customers that have paid & booked an Appointment as outlined above. By attending an Appointment, you will be deemed to have read, accepted and be bound by these terms and conditions, the Website Terms and Conditions of Use, the Terms of Use, our Privacy Policy, The Agreement and any other requirements set out in the materials for the Appointment (in the event of a conflict, the requirements set out in the materials for the Appointment will take precedence), as well as all applicable laws and regulations, including without limitation those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems. In booking an Appointment, participants confirm that they are eligible to do so and are eligible to redeem the Discount Code when applicable. The Provider may require participants to provide proof of such eligibility. By booking and an attending an Appointment, you warrant that all information submitted by you is true and accurate. The Provider reserves the right at its sole discretion to disqualify from further participation in the Service and prevent from making any Appointment or further Appointment any individual it has reason to believe is acting in any manner deemed by the Provider to be in violation of these terms and conditions, relevant laws and/or regulations and/or third party rights. This may include revoking the right to attend the Appointment and/or use the Discount Code. If the Provider subsequently discovers any redeemer of the Discount Code is ineligible, has breached these terms and conditions or is suspected of engaging in any other foul play or unethical conduct, then the Provider reserves the right (at its absolute discretion) not to honor the Discount Code to that individual.
15. ACCURACY OF INFORMATION
